Upon further consideration I am disposed to think that for the following reasons all suits should be commenced by Writ Of Summons. It will be seen by reference to the returns of the Supreme Court of Hong Kong, that a vast number of Actions are settled after the Issue of a Writ and without any further proceeding, and it seems to me that if the first step in a suit is to be the filing and Service of a Petition, which in many cases is a costly Instrument to prepare, it will act rather oppressively upon Defendants against whom proceedings are taken as is frequently the case before

they have had time to obtain advice as to whether they should defend or not, and at all events it involves a Preliminary Expense which is often an obstacle to an amicable Settlement.
